While neither state has a standalone right of publicity statute, both recognize similar claims under common law:

• In South Carolina, these matters fall under the tort of wrongful appropriation of personality, a form of invasion of privacy.

• In North Carolina, similar protections exist through the common law tort of misappropriation of name or likeness for commercial gain.
